Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and EMF Radar ("we," "us," "our," or the "Company") governing your access to and use of the emfradar.com website and all related services, features, content, and applications (collectively, the "Service").

We reserve the right to modify these Terms at any time. Your continued use of the Service after any modification constitutes your acceptance of the modified Terms.

Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By using the Service, you represent and warrant that you meet this eligibility requirement.

Description of Service

EMF Radar provides estimated electromagnetic field (EMF) exposure information for locations across the United States. Our Service includes EMF exposure scores for addresses, cities, and states; interactive maps displaying infrastructure data; educational content about EMF; and comparative data between locations.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY OR COMPLETENESS OF CONTENT, AVAILABILITY OR UNINTERRUPTED ACCESS, AND FREEDOM FROM VIRUSES OR HARMFUL COMPONENTS.

Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EMF RADAR, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

This includes damages resulting from:

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content
• Any decisions made or actions taken based on information from the Service
• Any property decisions influenced by our EMF scores
• Any perceived or actual health effects related to EMF exposure

Cap on Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US (IF ANY) IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

Indemnification

You agree to indemnify, defend, and hold harmless EMF Radar and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Any content you submit or transmit through the Service
• Your negligent or wrongful conduct
• Any decisions or actions you take based on information from the Service

Assumption of Risk

You acknowledge and agree that:

1. EMF exposure and its effects are subjects of ongoing scientific research. There is no scientific consensus on all aspects of EMF exposure and health.
2. Our scores are estimates, not measurements. Actual EMF levels at any location may differ materially from our estimates.
3. You are solely responsible for your decisions. Any decisions you make regarding property, residence, health, or otherwise based on our Service are made at your own risk.
4. We do not guarantee safety. A low EMF score does not guarantee low actual EMF exposure, and a high score does not indicate danger.
5. You should conduct independent verification. For important decisions, you should obtain professional EMF measurements and consult qualified experts.

BY USING THE SERVICE, YOU EXPRESSLY ASSUME ALL RISKS ASSOCIATED WITH YOUR RELIANCE ON THE INFORMATION PROVIDED.

Intellectual Property

The Service and its original content, features, and functionality are owned by EMF Radar and are protected by copyright, trademark, and other intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes.

This license does not include the right to:

• Modify, copy, or create derivative works of the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service for any commercial purpose without our prior written consent
• Scrape, crawl, or use automated means to access the Service

Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe the intellectual property or privacy rights of others
• Transmit viruses, malware, or other harmful code
• Interfere with or disrupt the Service
• Attempt to gain unauthorized access to any portion of the Service
• Use bots, scrapers, or automated means without permission
• Harass, abuse, or harm another person

We reserve the right to terminate or suspend your access to the Service immediately for any violation of these Terms.

Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Binding Arbitration

If we cannot resolve a dispute informally, you and EMF Radar agree to resolve any claims relating to these Terms or the Service through final and binding arbitration conducted by JAMS under its Streamlined Arbitration Rules.

Class Action Waiver

YOU AND EMF RADAR AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION.

Jury Trial Waiver

YOU AND EMF RADAR HEREBY WAIVE ANY RIGHT TO A JURY TRIAL IN CONNECTION WITH ANY ACTION OR LITIGATION ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE.

General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and EMF Radar.
• Severability: If any provision is held invalid, it will be modified or severed, and remaining provisions continue in effect.
• Waiver: Our failure to enforce any right will not be deemed a waiver.
• Assignment: You may not assign these Terms without our consent. We may assign without restriction.
